7.1 AVM Industrial Warning and Limited Warranty
AVM Industrial Operations Gas Springs and Dampers are intended for industrial applications only. Use of gas springs and dampers in any other application is improper and may lead to malfunctions or serious personal injuries. With respect to any application other than those set forth herein, AVM makes no express or implied warranties of any kind, including any warranties of merchantability or fitness for a particular purpose.
AVM warrants products to be free of defects due to parts or workmanship for a period of two years from the date of manufacture. This limited warranty does not apply to:
- any product altered or subjected to abuse, neglect, or misuse,
- any product that is improperly installed,
- gas spring output force, or
- costs associated with dealer labor, administration fees, and/or shipping and handling. AVM may offer up to a five year warranty for specific applications with AVM Engineering written approval prior to purchase.
AVM's sole obligation under this limited warranty is exchange of the defective product or reimbursement in the amount of the sales price. AVM is not responsible for part removal and installation or late or partial shipment. AVM shall not be liable for incidental or consequential damages. These limitations on liability shall be applicable to any claims presented to AVM, regardless of the legal theory forming the basis of such claim, and whether such theory involves negligence, contractual liability, or otherwise.
Except as set forth above, AVM disclaims any and all-express warranties. All implied warranties, including any warranty of merchantability or fitness for a particular purpose, are limited in duration to one year from manufacturing date. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some states do not allow the exclusion or limitation of Incidental or consequential damages, so the above limitation exclusion may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights, which vary, from state to state.
To make a claim under this limited warranty, products must be returned to AVM for claim certification and exchange. Return's and customer debit memos unaccompanied by a Return Good Authorization (RGA) Number will not be accepted. Sample lots of products that purchaser believes are defective may be sent back to AVM, along with an RGA number, for free test analysis. Any such products found to meet current drawing requirements will be returned at purchaser's cost. Returns outside of the warranty period will not be accepted.
